INTRODUCTION

Laudable is a software and services company that helps companies collect, use, and find voice of customer content to improve their buying experience and company growth rate.

We understand that you are aware of and care about your own personal privacy interests, and we take that seriously. This Privacy Notice describes Laudable's policies and practices regarding its collection and use of your personal data, and sets forth your privacy rights. We recognize that information privacy is an ongoing responsibility, and so we will from time to time update this Privacy Notice as we undertake new personal data practices or adopt new privacy policies.

This Privacy Policy describes how LAUDABLE (the “Company”, “we”, or “us”) collects, uses, stores, shares and protects your personal data in connection with your use of the "Services" – comprised of the sites at both laudable.com domain name and grademycasestudy.com domain name (the “Site”), any services offered by us for editing and production of video content, the software at app.laudable.com (the “App”), and any other services that we currently offer or may offer in the future.

Please read this policy carefully. By accessing the Services or submitting your personal information (defined below) in order to receive the Services, you agree to the terms set forth in this privacy policy. If you do not accept the terms of this privacy policy, do not access or use the Services.

Laudable will notify you of any changes to this privacy policy by posting the updated privacy policy and its effective date on this page. Thus, you should visit this page periodically to identify and understand any such changes. By continuing to access or use the Services after a modification, you agree to be bound by the modified privacy policy.

INFORMATION COLLECTED BY LAUDABLE

Laudable collects personal information about its website visitors and customers. With a few exceptions, this information is generally limited to:

  • name
  • job title
  • employer name
  • work address
  • work email
  • work phone number
  • We use this information to provide prospects and customers with services.
  • We do not sell personal information to anyone and only share it with third parties who are facilitating the delivery of our services.
  • From time to time, Laudable receives personal information about individuals from third parties. Typically, information collected from third parties will include further details on your employer or industry. We may also collect your personal data from a third party website (e.g. LinkedIn)

Collection of personal information

Laudable does not collect personal information unless you voluntarily submit it in connection with your use of the Services, send inquiries to Laudable, send inquiries through forms located on the website, or participate in certain activities available via the Services. We collect personal information when you choose to use certain features of the Services, including when you: (i) create an account on the website or the app; (ii) submit a URL on grademycasestudy.com, (iii) engage in certain activities available via the Services, such as viewing or engaging with content, videos, or photographs; or (iv) consent to receive commercial or promotional email, direct mail, or sms/text messages about upcoming information, promotions or events. You can always choose not to be contacted or to “opt-out” of further contact or solicitations from Laudable by following the instructions in the communications, or emailing privacy@laudable.com.

Information gathered automatically

Laudable may automatically collect certain non-identifying information about you (such as your movement through the website or app, how you engage with videos, the pages you visit most frequently, the type of browser or computer operating system you use).

In addition, Laudable may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile devices’ unique device id, the ip address of your mobile device, your mobile operating system, the type of mobile internet browsers you use, and the information about the way you use the Services.

Laudable may collect other passive information using technologies such as standard server logs, cookies and clear gifs (“web beacons”). Web beacons are small pieces of information or data stored on your computer or mobile device that are used to determine your preferences and track your search terms and other behaviors or activities as you navigate around the internet (collectively, “user behavior”). If you object to this practice, you may erase or block certain web beacons. We recommend, however, that you allow web beacons to be stored on your computer or mobile device as they may be needed to properly use the Services.

Information gathered using remote recording technology

If you use our remote recording technology as an interviewee guest (as defined below), please know that your personal information, including the recording of your video and audio, will be collected, and shared with our Customer (the vendor you agree to participate in a testimonial about). If you do not agree to the collection of your personal information or sharing with our Customer user, then do not agree to participate in a a testimonial video.

For purposes of this subsection, interviewee guest shall mean any individual who is participating in a testimonial video interview by Laudable and being recorded. For purposes of this policy.

CHANGING OR REMOVING YOUR PERSONAL INFORMATION

Laudable will retain any personal information that you submit in connection with your account unless Laudable deems such personal information to violate this agreement or until such time as you decide to remove such personal information. You understand that deleted personal information may persist for a reasonable period of time in backup copies but will not be available to others.

If you wish to review, change, or remove any personal information that you have provided in connection with the Services, or if you wish to delete your account with us, please email privacy@laudable.com with the subject line “Delete Laudable account”

USE OR DISCLOSURE OF YOUR INFORMATION

Laudable may use your personal information to contact you regarding the Services. We may also use your personal information to provide Services requested by you and for internal research and marketing purposes. We may share your personal information and non-identifying information that we collect from you with our parent, subsidiaries, divisions, affiliates, or third party contractors.

Laudable may share your user behavior on the website with certain advertisers and such advertisers may respond to your user behavior on the website with advertisements or sponsored content.

Laudable will not use, disclose, or sell your personal information to any third parties for any purposes other than those necessary to deliver the Services. Otherwise, we will not sell or transfer to unaffiliated third parties any personal information that you submit or any non-identifying information collected without your consent.

The personal information and non-identifying information we collect from you may be used as follows:

  • To personalize your experience and respond to your specific needs;
  • To improve the Services;
  • To improve customer service;
  • To administer promotions, surveys or other features for the Services;
  • To communicate with you;
  • To share updates concerning information pertaining to Laudable;
  • To send promotional offers or discounts related to Laudable or its affiliates and information related to products you have viewed via the Services; and/or
  • As an asset in connection with a potential or actual merger or sale (including any transfers made as part of an insolvency or bankruptcy proceeding) involving all or part of our business or as part of a corporate reorganization, stock sale or other change in control.

Notwithstanding the foregoing or any other statements or representations here or elsewhere, Laudable reserves the right to disclose any personal information in our possession if Laudable believes that such disclosure is necessary: (i) to conform to legal requirements or to respond to a subpoena, search warrant, or other legal process received by Laudable, whether or not a response is required by applicable law; (ii) to enforce or protect Laudable's rights; or (iii) to protect the safety of users of Laudable's Services and members of the general public.

COOKIES AND TRACKING TECHNOLOGY

Laudable makes available a comprehensive Cookie Policy that describes the cookies and tracking technologies used on Laudable's website and provides information on how users can accept or reject them.

SHARING INFORMATION WITH THIRD PARTIES

The personal information Laudable collects from you is stored in one or more databases hosted by third parties located in the United States. These third parties do not use or have access to your personal information for any purpose other than cloud storage and retrieval. On occasion,Laudable engages third parties to send information to you, including information about our products, services, and events.

We do not otherwise reveal your personal data to non-Laudable persons or businesses for their independent use unless:

  • you request or authorize it;
  • it’s in connection with Laudable-hosted and Laudable co-sponsored conferences as described above;
  • the information is provided to comply with the law (for example, compelled by law enforcement to comply with a search warrant, subpoena, or court order), enforce an agreement we have with you, or to protect our rights, property or safety, or the rights, property or safety of our employees or others;
  • the information is provided to our agents, vendors or service providers who perform functions on our behalf;
  • to address emergencies or acts of God; or
  • to address disputes, claims, or to persons demonstrating legal authority to act on your behalf. We may also gather aggregated data about our services and website visitors and disclose the results of such aggregated (but not personally identifiable) information to our partners, service providers, advertisers, and/or other third parties for marketing or promotional purposes.

The Laudable and Grade My Case Study websites connect with third party services such as Facebook, LinkedIn, Google, and others. If you choose to share information from the Laudable or Grade My Case Study websites through these services, you should review the privacy policy of those services. If you are a member of a third party service, the aforementioned connections may allow that service to connect your visit to our site to your personal data.

TRANSFERRING PERSONAL DATA TO THE U.S.

Laudable has its headquarters in the United States. Information we collect about you will be processed in the United States. By using Laudable’s services, you acknowledge that your personal information will be processed in the United States. The United States has not sought nor received a finding of “adequacy” from the European Union under Article 45 of the GDPR. Pursuant to Article 46 of the GDPR, Laudable is providing for appropriate safeguards by entering binding, standard data protection clauses, enforceable by data subjects in the EEA and the UK. These clauses have been enhanced based on the guidance of the European Data Protection Board and will be updated when the new draft model clauses are approved.

Depending on the circumstance,Laudable also collects and transfers to the U.S. personal data with consent; to perform a contract with you; or to fulfill a compelling legitimate interest of Laudable in a manner that does not outweigh your rights and freedoms. Laudable endeavors to apply suitable safeguards to protect the privacy and security of your personal data and to use it only consistent with your relationship with Laudable and the practices described in this Privacy Statement. Laudable also enters into data processing agreements and model clauses with its vendors whenever feasible and appropriate. Since it was founded, Laudable has received zero government requests for information.

Data Subject rights

The European Union’s General Data Protection Regulation (GDPR) and other countries’ privacy laws provide certain rights for data subjects. Data Subject rights under GDPR include the following:

  • Right to restrict processing
  • Right of data portability
  • Right to object
  • Rights related to automated decision making including profiling

This Privacy Policy is intended to provide you with information about what personal data Laudable collects about you and how it is used. 

If you wish to confirm that Laudable is processing your personal data, or to have access to the personal data Laudable may have about you, please contact us.

You may also request information about: the purpose of the processing; the categories of personal data concerned; who else outside Laudable might have received the data from Laudable; what the source of the information was (if you didn’t provide it directly to Laudable); and how long it will be stored. You have a right to correct (rectify) the record of your personal data maintained by Laudable if it is inaccurate. You may request that Laudable erase that data or cease processing it, subject to certain exceptions. You may also request that Laudable cease using your data for direct marketing purposes. In many countries, you have a right to lodge a complaint with the appropriate data protection authority if you have concerns about how Laudable processes your personal data. When technically feasible, Laudable will—at your request—provide your personal data to you.

Reasonable access to your personal data will be provided at no cost. If access cannot be provided within a reasonable time frame, Laudable will provide you with a date when the information will be provided. If for some reason access is denied, Laudable will provide an explanation as to why access has been denied.

DATA STORAGE AND RETENTION

Your personal data is stored by Laudable on its servers, and on the servers of the cloud-based database management services the Laudable engages, located in the United States. Laudable retains service data for the duration of the customer’s business relationship with Laudable and for a period of time thereafter, to analyze the data for Laudable’s own operations, and for historical and archiving purposes associated with Laudable’s services. Laudable retains prospect data for at least one (1) year, or as long as is needed to fulfill the purposes outlined in this privacy policy, unless a longer retention period is required or permitted by law, at which time it is purged from Laudable systems. All personal data that Laudable controls may be deleted upon verified request from Data Subjects or their authorized agents. SECURITY

Laudable has reasonable security measures in place to protect personal information you submit in order to receive the Services. We believe the measures we implement will reduce security problems and will take our best efforts to maintain any security. When you communicate with Laudable electronically or submit your personal information, your communication is subject to all of the risks of communication and other factors that may compromise the security of such personal information.

LINKS

We may incorporate third party software, APIs, and SDKs (including open source software) into our technology or the Services. Laudable is not responsible for the privacy policies or practices of such third parties, including on such third parties’ websites. When linking to a third party website, you should read the privacy policy stated on that website. This privacy policy only governs personal information, non-identifying information and content collected in connection with the Services.

LEGAL BASIS FOR PROCESSING

If you are an individual from the EEA or Switzerland, our legal basis for processing your personal information will depend on the personal information concerned and the specific context in which it is collected. However, we will normally collect or process personal information from you only when:

  • We have your consent;
  • We need the personal information to perform a contract with you (to deliver Services); or
  • The party is in our or a third party’s legitimate interests (and not overridden by your data protection interests or fundamental rights and freedoms).

In some cases, we may also have a legal obligation to process personal information from you, or may need the personal information to protect your vital interest or those of another person.

ACCESS TO PERSONAL DATA

Customers, interviewee guests, and customers' customers or other parties who interact with Laudable's Services may ask to review, correct, update, or delete personal data that we maintain about them by sending an email to privacy@laudable.com with subject line “Personal data request”.

ADDITIONAL PROTECTIONS FOR CHILDREN

The Services are not designed for or targeted to children under the age of 13, and Laudable will not knowingly solicit or collect the personal information of a child under the age of 13. If we discover that personal information of a child under the age of 13 has been submitted without verifiable parental consent, we will delete such personal information and revoke access to the Services.

CALIFORNIA PRIVACY RIGHTS

Under California law, California residents who provide personal information in obtaining products or Services for personal, family or household use are entitled to request and obtain from us once a calendar year information about the customer information we shared, if any, with other businesses for their own direct marketing uses. If applicable, this information would include the categories of customer information and the names and addresses of those businesses with which we shared customer information for the immediately prior calendar year (meaning that requests made in 2017 will receive information regarding 2016 sharing activities).
